Terms of Service

1. Acceptance. By creating an account or using Vintly ("the Service"), you agree to these Terms. If you do not agree, do not use the Service.

2. What Vintly does. Vintly is an AI assistant that generates draft listings (title, description, price suggestion, etc.) from photos of clothing items you provide. The Service is provided "as is" and is not affiliated with, endorsed by, or operated by Vinted UAB.

3. Accounts. You are responsible for keeping your login credentials secure and for all activity under your account. You must be at least 16 years old to use Vintly.

4. Acceptable use. You may not (a) upload photos you don't have rights to, (b) attempt to reverse-engineer the Service, (c) use Vintly to generate misleading or fraudulent listings, or (d) abuse, overload, or attempt to disrupt the Service.

5. Acceptable Use. Users may not upload, process, or generate listings for NSFW, adult, pornographic, or sexually explicit visual content through Vintly. Vintly reserves the right to terminate accounts that violate this policy immediately and without notice.

6. Free and Premium plans. Free users get a limited number of analyses. Premium subscriptions unlock additional features and are billed in advance on a weekly, monthly or yearly basis depending on the plan you select. You can cancel any time from your account; cancellation stops future charges but does not refund the current period.

7. AI output. AI-generated content can be incorrect or incomplete. You are responsible for reviewing every listing before publishing it on Vinted. Vintly makes no guarantee that an item will sell or sell at any particular price.

8. Your content. You keep ownership of the photos you upload. You grant Vintly a limited license to process them solely to generate listings and operate the Service.

9. Termination. We may suspend or terminate your account or access to the Service if you violate these Terms. Vintly is not liable for any resulting loss of access to generated content or account history. You can delete your account at any time from your settings.

10. Disclaimer of warranties. The Service is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, our total liability is limited to the amount you paid us in the 12 months preceding the claim.

11. Changes. We may update these Terms; we'll notify you of material changes. Continued use after changes means you accept the updated Terms.

13. Governing law & jurisdiction. These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules. For consumers, mandatory statutory consumer-protection rights and jurisdiction under EU and German law remain unaffected.

14. Indemnification. You agree to indemnify and hold Vintly harmless from claims, damages, and reasonable expenses arising out of your misuse of the Service, violation of these Terms, or infringement of third-party rights, including but not limited to uploading photos or content you do not have the right to use.

15. Intellectual property. Vintly's software, branding, trademarks, and the AI-generated formatting, structure, and presentation of listings are owned by Vintly. You do not acquire any ownership rights in the underlying Service by using it. You retain ownership of your own photos and factual product information.

16. Third-party services disclaimer. Vintly integrates with third-party services and platforms (including but not limited to Vinted, Whop, Apple App Store / RevenueCat, and Google) that are not controlled by Vintly. Vintly is not responsible for their availability, policies, changes, or actions, such as Vinted account suspensions or payment processor issues.
